PUBLIC OFFER AGREEMENT

This Public Offer (hereinafter referred to as the “Offer”) is an official and public invitation by the Non-Governmental Organization “HORIZON OF CHANGES” (hereinafter referred to as the “Organization”), represented by its Director acting on the basis of the Statute, to enter into an Agreement on Making a Charitable Donation (hereinafter referred to as the “Agreement”) with any individual or legal entity (hereinafter referred to as the “Donor”) who responds to this appeal.

1. General Provisions

1.1. This Agreement is a public contract pursuant to Articles 633 and 641 of the Civil Code of Ukraine.

1.2. Acceptance of the Offer occurs when the Donor transfers funds to the Organization’s bank account using the payment tools available on the Website or via direct bank transfer. Acceptance signifies full and unconditional agreement with all terms and conditions of this Agreement.

2. Subject of the Agreement

2.1. The subject of this Agreement is the voluntary, gratuitous, and irrevocable transfer of funds (Charitable Donation) by the Donor to the ownership of the Organization to support and finance the statutory activities of the Organization.

2.2. The Donor independently determines the amount of the charitable donation. The Organization does not provide the Donor with any material or other compensation for providing the donation.

3. Rights and Obligations of the Parties

3.1. The Organization has the right to:

• Accept Charitable Donations and utilize them in accordance with the Organization’s Statute and the legislation of Ukraine.
• With the Donor’s consent, publish information about the provided assistance (without disclosing personal data, unless agreed otherwise).
  3.2. The Organization is obliged to:
• Use the received funds exclusively for the implementation of statutory activities, charitable programs, projects, and administrative expenses related to their execution.
  3.3. The Donor has the right to:
• Monitor the targeted use of the donation by reviewing the Organization’s reports, which are published in the public domain.

4. Location of Fundraising

4.1. The public collection of Charitable Donations is carried out worldwide via the Organization’s website and bank accounts opened in financial institutions of Ukraine.

5. Term of Fundraising and Utilization of Donations

5.1. The public collection of funds is ongoing until the termination of the Organization’s activities, unless a different term is specified for a specific project or fundraising campaign.

5.2. The received donations are utilized by the Organization in accordance with its statutory activities and the current legislation of Ukraine.

6. Personal Data Protection

6.1. By accepting this Offer, the Donor consents to the collection, processing, and storage of their personal data in accordance with the Law of Ukraine “On Personal Data Protection” for the purpose of ensuring communication and implementing charitable activities.

7. Final Provisions

7.1. This Agreement shall be governed by and construed in accordance with the current legislation of Ukraine.

7.2. The Organization reserves the right to unilaterally amend the text of this Offer by publishing a new version on the Website.
